Summary —

The ADIA Standard Equipment Sale Contract is to undergo a revision and member businesses are invited to contribute to this work in order to ensure the agreement reflects contemporary business arrangements.

Key Issues For Consideration —

The Australian Dental Industry Association (ADIA) publishes the ADIA Standard Equipment Sale Contract for the supply of dental equipment that sets the terms and conditions associated with the sale of dental equipment by member businesses to dental practices.  This contract is now being reviewed and the Association is inviting members the opportunity to contribute to this task.

A task group is being formed to review the terms and conditions within the ADIA Standard Equipment Sale Contract in order to ensure that the contract:

  Reflects the contemporary commercial practices of the industry;
  Provides appropriate levels of protection for member businesses; and
 

Is user friendly and is in a format readily useable by member businesses.

The ADIA Standard Equipment Sale Contract was last reviewed in 2011 to ensure its consistency with requirements set out in the Australian Consumer Law insofar as they apply to business-to-business dealings.  As part of this review we will seek expert legal advice in order to ensure that the contract continues to ensure that the ADIA member businesses using the document meet their compliance obligations.

It is expected that this task group will meet monthly until December 2016 with the aim of publishing a new version of the agreement early in the new year.  Meetings will be held via teleconference.
